TERMS & CONDITIONS – DUSKWARD HOUSE

3. PARTIES TO THE CONTRACT

Electronic contracting is carried out between:

A natural person who:

  • Is 18 years of age or older.
  • Resides in a country where access to this type of content is legal.
  • Is responsible for providing truthful and accurate information.
  1. b) The Owner

Liliana Cardona, owner of Duskward House.

To complete a purchase, the Client must provide:

  • Email
  • Password
  • Billing details where applicable

Payments are processed exclusively through:

  • Stripe
  • PayPal
  • ThriveCart

The website does not store any banking or credit card information.

4. RIGHT OF EXCLUSION

The Owner may suspend or deny access—without prior notice—to any Client who:

  • Breaches these Terms.
  • Attempts to share content or login credentials.
  • Performs massive, automated, or fraudulent access attempts.
  • Reproduces, copies, or distributes content without authorization.

In cases of fraud, access may be terminated without refund.

5. ELECTRONIC CONTRACTING PROCESS

Digital Literary Products:
Special chapters, bonus content, extended stories.

The Owner may add, modify, or update services at any time.

5.2 Contracting Steps

Step 1 – Service Selection

The Client selects the desired subscription or digital product.

Step 2 – Account Registration

An account is created with:

  • Email
  • Password
  • Billing details (if required)

The Client declares they are 18 years or older.

Step 3 – Payment

Payments are processed through:

  • Stripe
  • PayPal
  • ThriveCart

These platforms ensure encrypted and secure payment processing.

Step 4 – Confirmation & Access

After completing the payment, the Client receives:

  • A confirmation email
  • Immediate access to the purchased content

6. PRICES AND PAYMENT METHODS

Prices are displayed before purchase.

Accepted payment methods:

  • PayPal
  • Stripe
  • Additional platforms (e.g., ThriveCart) may be added in the future

All payments are processed via secure SSL-encrypted connections.

7. INTELLECTUAL PROPERTY

All content on Duskward House is the exclusive property of Liliana Cardona or her licensors:

  • Texts
  • Chapters
  • Stories
  • Images
  • Website design, structure, and style

The following is strictly prohibited:

  • Reproducing, distributing, or copying content
  • Sharing screenshots
  • Granting access to third parties
  • Translating, adapting, or transforming works without authorization

The Client acquires a personal, non-transferable license, not ownership rights.

7.1 Prohibition on Sharing Licenses

It is forbidden to:

  • Share usernames or passwords
  • Participate in group access (“shared accounts” or “joint purchases”)
  • Repost or redistribute content in any way

Violation constitutes a serious infringement and may lead to:

  • Immediate suspension of access
  • Legal action for damages
  • In Spain, potential criminal liability under Article 270 of the Criminal Code (penalties up to 4 years imprisonment)

8. RIGHT OF WITHDRAWAL & REFUND POLICY

Duskward House provides digital products with immediate access, therefore:

  • No right of withdrawal applies once access to the content has begun.
  • By completing the payment, the Client agrees to waive the statutory right of withdrawal.
  • No refunds will be issued for already activated subscriptions.

 

Legal basis in the EU: Article 103.m) of the Spanish Consumer Protection Law.
Canada / USA: Digital goods with immediate access are not refundable unless a technical failure-caused by the platform-prevents access.

If a technical error attributable to the platform occurs, the case will be reviewed individually.

9. DISCLAIMER OF LIABILITY

The Owner does not guarantee:

  • Uninterrupted availability of the website
  • Absence of technical failures
  • Immunity against viruses or cyberattacks

Reasonable measures will be taken to restore service quickly in the event of disruptions.

10. PROCESSING OF PERSONAL DATA

Personal data is processed in accordance with the website’s Privacy Policy.

Applicable regulations include:

11. TERMINATION OF THE CONTRACT

The contract may be terminated when:

  • The Client cancels their subscription
  • These Terms are breached
  • Fraud or misuse is detected
  • The Client requests deletion of essential data required for the account

Cancellation does not entitle the Client to a refund for billing periods already in progress.

12. LANGUAGE

These Terms are provided in Spanish and may also be offered in English for international customers.

In case of discrepancies, the Spanish version shall prevail.

13. APPLICABLE LAW AND JURISDICTION

For Clients in the European Union:

Spanish law applies.
Any dispute will be submitted to the Courts of Girona, unless mandatory consumer law states otherwise.

For Clients in Canada:

Federal law under PIPEDA applies.
Disputes may be resolved under the provincial laws of the Client’s residence.

For Clients in the United States:

Applicable state laws regarding digital commerce and privacy apply
(e.g., CCPA/CPRA for California residents).

Clients agree that disputes may be resolved in accordance with the laws of their state or jurisdiction.
